Algemene Voorwaarden – Taxi Benjamin

1. Definities

1. Taxi Benjamin, ingeschreven bij de Kamer van Koophandel onder nummer 72862505: de onderneming die taxiservices aanbiedt onder de naam Taxi Benjamin.
2. Klanten: natuurlijke personen of rechtspersonen die gebruikmaken van de diensten van Taxi Benjamin.
3. Diensten: het aanbieden van personenvervoer per taxi, inclusief het ophalen en afzetten van passagiers op de afgesproken locaties.

2. Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op alle diensten, offertes en overeenkomsten tussen Taxi Benjamin en de klant.
2. Afwijkingen van deze voorwaarden zijn alleen geldig indien schriftelijk bevestigd door Taxi Benjamin.

3. Reserveringen en ritten

1. Reserveringen kunnen telefonisch, via e-mail of via de website worden gemaakt.
2. Taxi Benjamin streeft ernaar de ritten op tijd uit te voeren, maar kan niet aansprakelijk worden gesteld voor vertragingen door omstandigheden buiten haar macht.
3. Klanten dienen op tijd aanwezig te zijn op het afgesproken ophaaladres. Bij stadsritten is 10 minuten wachttijd inbegrepen. Bij luchthavenritten is 60 minuten wachttijd inbegrepen. Indien de chauffeur langer moet wachten, kan extra wachttijd in rekening worden gebracht van €50 per uur.

4. Tarieven en betaling

1. De tarieven zijn conform de op het moment van de rit geldende prijslijst van Taxi Benjamin.
2. Betaling kan contant of via pin/creditcard worden voldaan, tenzij schriftelijk anders is overeengekomen.
3. Taxi Benjamin behoudt zich het recht voor om bij onbetaalde ritten incassomaatregelen te treffen.

5. No-show beleid

• Voor stadsritten geldt: 15 minuten na het afgesproken ophaalmoment wordt dit beschouwd als een no-show.
• Voor luchthavenritten geldt een no-show na 90 minuten.
• Vooruit betaalde ritten worden bij een no-show niet gecompenseerd of gerestitueerd.

6. Annulering

1. Annuleringen dienen zo spoedig mogelijk te worden doorgegeven.
2. Bij annulering binnen 24 uur voor de geplande rit kan een annuleringsvergoeding in rekening worden gebracht.

7. Aansprakelijkheid

1. Taxi Benjamin is alleen aansprakelijk bij opzet of grove nalatigheid.
2. Taxi Benjamin is niet aansprakelijk voor verlies of schade aan persoonlijke eigendommen.
3. Klanten zijn verantwoordelijk voor hun eigen gezondheidstoestand.

8. Gedrag en veiligheid

1. Klanten dienen de instructies van de chauffeur op te volgen.
2. Roken, drugsgebruik en agressief gedrag zijn verboden en kunnen leiden tot beëindiging van de rit zonder restitutie.

9. Privacy en persoonsgegevens

1. Taxi Benjamin verwerkt persoonsgegevens conform de AVG.
2. Gegevens worden uitsluitend gebruikt voor ritten, facturatie en communicatie.

10. Klachten

1. Klachten dienen binnen 7 dagen na de rit schriftelijk te worden ingediend.
2. Taxi Benjamin streeft naar een snelle en correcte afhandeling.

11. Overmacht

Taxi Benjamin is niet aansprakelijk bij overmacht, waaronder maar niet beperkt tot ziekte, verkeersongelukken, extreme weersomstandigheden, files of wegafsluitingen.

12. Toepasselijk recht en geschillen

1. Op alle overeenkomsten is Nederlands recht van toepassing.
2. Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement waar Taxi Benjamin is gevestigd.

Terms & Conditions – Taxi Benjamin

1. Definitions

1. Taxi Benjamin, registered with the Dutch Chamber of Commerce under number 72862505: the company providing taxi services under the name Taxi Benjamin.
2. Customers: individuals or legal entities using the services of Taxi Benjamin.
3. Services: providing passenger transport by taxi, including pickup and drop-off at agreed locations.

2. Applicability

1. These terms and conditions apply to all services, offers, and agreements between Taxi Benjamin and the customer.
2. Deviations from these terms are valid only if confirmed in writing by Taxi Benjamin.

3. Reservations and rides

1. Reservations can be made by phone, email, or via the website.
2. Taxi Benjamin strives to execute rides on time but cannot be held liable for delays due to circumstances beyond its control.
3. Customers must be present on time at the agreed pickup location. For city rides, 10 minutes waiting time is included. For airport rides, 60 minutes waiting time is included. If the driver has to wait longer, extra waiting time may be charged at €50 per hour.

4. Rates and payment

1. Rates are in accordance with the price list valid at the time of the ride.
2. Payment can be made in cash or by card, unless otherwise agreed in writing.
3. Taxi Benjamin reserves the right to take collection measures for unpaid rides.

5. No-show policy

• For city rides: considered a no-show 15 minutes after the agreed pickup time.
• For airport rides: no-show after 90 minutes.
• Prepaid rides are not compensated or refunded in case of no-show.

6. Cancellation

1. Cancellations should be communicated as soon as possible.
2. Cancellations within 24 hours before the scheduled ride may incur a cancellation fee.

7. Liability

1. Taxi Benjamin is only liable in case of intent or gross negligence.
2. Taxi Benjamin is not responsible for loss or damage to personal belongings.
3. Customers are responsible for their own health condition.

8. Conduct and safety

1. Customers must follow the driver's instructions.
2. Smoking, drug use, and aggressive behavior are prohibited and may result in termination of the ride without refund.

9. Privacy and personal data

1. Taxi Benjamin processes personal data in accordance with the GDPR.
2. Data is used solely for rides, billing, and communication.

10. Complaints

1. Complaints must be submitted in writing within 7 days after the ride.
2. Taxi Benjamin aims for prompt and proper handling.

11. Force majeure

Taxi Benjamin is not liable in case of force majeure, including but not limited to illness, traffic accidents, extreme weather conditions, traffic jams, or road closures.

12. Governing law and disputes

1. Dutch law applies to all agreements.
2. Disputes are submitted to the competent court in the district where Taxi Benjamin is located.
